Terms of Service

These terms govern your use of this website and any request for service you submit through it. This site is operated by Phoenix Auto Repair, located at 725 Calhoun Ave, Nashville, TN 37210. By using the site or submitting a form, you agree to these terms. If you do not agree, please do not use the site.

What this site is

This is an advertising and appointment-request site. Nothing on it is an offer that becomes a binding contract when you submit a form. Submitting a form starts a conversation: we call you back, discuss what your vehicle needs, and quote the work. A repair agreement is formed at the shop, in writing, before work begins.

Pricing, offers, and estimates

Advertised prices apply to the specific service described, on eligible vehicles, and are subject to change. The $399 brake service is priced per axle and covers the parts and labor described on the offer page. Some vehicles require parts or labor outside that scope. Where that is the case we tell you before any work begins, and you decide whether to proceed.

Taxes, shop supplies, and disposal fees are disclosed on your written estimate. Offers cannot be combined with other discounts unless we say so in writing.

Your rights under Tennessee repair law

Tennessee law gives you specific rights when a repair facility works on your vehicle. Under Tenn. Code Ann. § 66-19-104, before we begin any repair work we will inform you that you:

  • may request a written estimate for repairs costing more than two hundred fifty dollars ($250);
  • may not be charged more than twenty-five percent (25%) in excess of that written estimate without your consent, or a good-faith attempt to obtain it; and
  • may not be charged for repairs you did not originally authorize, unless we make a good-faith attempt to reach you first. A good-faith attempt includes at least an attempted telephone call to you.

Under Tenn. Code Ann. § 47-18-104(b)(28), you may also request the return of parts removed from your vehicle, or ask to inspect them, if you say so at the time you authorize the work. Some parts cannot be returned — those subject to a core charge or trade-in agreement unless you pay that charge, those a manufacturer requires us to return under warranty, and those the law requires us to dispose of.

Nothing in these terms waives or limits any right Tennessee law gives you. Where these terms and Tennessee law conflict, Tennessee law controls.

Warranty

Qualifying repairs performed at our shop carry a 36-month / 36,000-mile warranty, whichever comes first, covering the parts and labor on the work we performed. The warranty does not cover damage from accident, abuse, neglect, continued driving after a fault appears, modifications, or the failure of components we did not service. Warranty service is performed at our shop.

This warranty is the full extent of what we promise about our work. To the extent Tennessee law allows, we make no other warranties, express or implied. This paragraph does not limit any warranty right that cannot be waived under Tennessee law.

Appointments, vehicle drop-off, and abandoned vehicles

We will give you an estimated completion time. Parts availability, hidden damage, and additional authorized work can change it, and an estimated time is not a guarantee. If you leave a vehicle with us after work is complete and do not retrieve it after we notify you, storage charges may apply, and we may pursue the remedies available to repair facilities under Tennessee law, including a garagekeeper's lien.

Financing and third-party services

Financing is offered through a third-party provider (Koalafi) on qualifying jobs. We do not make credit decisions, and approval, terms, and rates are set by that provider under its own agreement with you. Courtesy rides and loaner vehicles are offered subject to availability and, in the case of rideshare, are provided by the rideshare company under its own terms.

When you submit a form, you agree that we may contact you by phone, text message, or email at the details you provided, including calls or texts placed with automated technology. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to any text to opt out, or tell us on a call and we will stop.

Using this site

Please submit accurate information, and only your own contact details or those you are authorized to give us. Do not attempt to interfere with the site, access it by automated means, scrape its content, or use it for any unlawful purpose.

The text, photographs, logos, and layout on this site belong to Phoenix Auto Repair or are used with permission. You may not copy or republish them without our written consent. Customer reviews and photographs are used with the permission of the people who provided them.

Accuracy of site content

We work to keep this site accurate and current, but we do not promise that every detail is free of error or omission. Service descriptions, prices, hours, and availability can change. If something here conflicts with your written estimate or repair order, that document controls.

Limitation of liability

To the fullest extent Tennessee law allows, our liability arising out of your use of this website is limited to the amount you paid us, if anything, for the service at issue. We are not liable for indirect, incidental, or consequential damages arising from your use of this site.

This limitation applies to your use of the website. It does not limit our responsibility for the repair work we actually perform, which is governed by your repair order, our warranty, and Tennessee law. It does not exclude liability for personal injury, gross negligence, or willful misconduct, or any liability that cannot be limited under Tennessee law.

Governing law and where disputes are heard

These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute arising out of these terms or your use of this site will be brought in the state or federal courts located in Davidson County, Tennessee, and you and Phoenix Auto Repair consent to the jurisdiction of those courts.

Nothing here prevents either of us from bringing a qualifying claim in a Tennessee court of general sessions or small claims division.

Changes to these terms

We may update these terms. When we do, we will revise the date at the top of this page. Continued use of the site after a change means you accept the updated terms.
